Congressman Andy Kim wins reelection in 3rd District in New Jersey, defeating David Richter. Congressman Kim, with local offices in Willingboro New Jersey and Marlton New Jersey will be serving his second term in Congress. Congressman Kim is a supporter of various education bills, including H.R. 770 which is the Discharge Student Loans in Bankruptcy Act of 2009 and HR 4674 which is the College Affordability Act. At one time student loans could be eliminated in bankruptcy. The laws gradually changed to allowing student loans to be discharged only in a chapter 13 and then only if a certain number of years passed since the loan first became due. Now, they can only be discharged if a hardship can be established. Based on the applicable case law, it is very difficult to establish a hardship.
